Both Myvi Drivers Charged Over Fatal DUKE Crash Plead Not Guilty

At the Kuala Lumpur magistrate’s court, both Perodua Myvi drivers that were involved in the crash along kilometre 6.2 of the DUKE highway during the wee hours of Saturday, 2 May 2015 that caused the death of two adults and an infant have pleaded not guilty.

In the investigation into accident, 31-year old Mohammed Reza Fizal Jamaluddin and 35-year old Siti Noor Aini Mohd Said were arrested and charged under Section 41 of the Road Transport Act 1987 for causing death by reckless driving.

The collision involved two Perodua Myvis that were allegedly involved in a race along the highway when it came into contact with a Mitsubishi Pajero driven by 35-year old Fairuz Nizam Husain. His wife 25-year old Nova Safitri Azhari and seven-month old daughter Nur Fizura Annisa were passengers, all three occupants of the SUV perished in the crash. 

Under the conditions of having their driving licenses suspended and passports held by the police until the end of the trial, deputy public prosecutor Suhaimi Ibrahim asked the court to impose a bail of RM15,000 each.

However, lawyers representing both of the accused have asked for the bail amount to be reduced in light of the fact that each of them have an income of RM2,000 and young children in their care. Following the request, Judge Noorul Fhaiez Mohd Nayan set the revised bail at RM9,000 each as well as ordered them to hand over their passports and their driving license.

Both drivers could have a minimum two year jail sentence and a RM5,000 fine if found guilty.
